Terms of Service

Last updated: 24 October 2026

These Terms of Service ("Terms") are a legal agreement between you and Long Form Marketer (ABN 78 526 391 894) of 506/71 Macquarie Street, Sydney NSW 2000, Australia ("Long Form Marketer", "we", "us", "our"). They govern your access to and use of Makevio, including the website at makevio.com, the web application at app.makevio.com, and any related services (together, the "Service").

By creating an account, starting a trial, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use Makevio

1.1 You must be at least 18 years old to use the Service.

1.2 Makevio is for business owners and may only be used for business purposes (for example, to market your coaching or education business). By using the Service you confirm you are a business owner and are using it for business purposes.

1.3 If you use the Service on behalf of a company or other organisation, you confirm you have authority to accept these Terms on its behalf, and "you" includes that organisation.

1.4 You may not use the Service if you are barred from doing so under the laws of Australia or any other applicable jurisdiction, including sanctions laws.

2. Your account

2.1 You must give accurate information when you create your account and keep it up to date.

2.2 You are responsible for keeping your login details secure and for all activity under your account. Accounts are for one person. You must not share your account or login details.

2.3 Tell us immediately at support@makevio.com if you believe your account has been accessed without your permission.

3. Your licence to use the Service

3.1 The Service is licensed, not sold. When you subscribe, start a trial or otherwise get access, you do not buy or own any part of the Service. You are buying a limited right to access and use it for the period of your subscription or trial.

3.2 Subject to these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own business purposes during your subscription or trial.

3.3 We (and our licensors) keep all rights, title and interest in the Service, including its software, design, prompts, methodologies, workflows, templates, text, graphics, logos, and all related intellectual property. The Makevio name and logo are our trade marks. Nothing in these Terms transfers any of these rights to you, except the limited licence in clause 3.2.

4. Plans, trials, credits and usage limits

4.1 Plans. The Service is offered under plans described at the time you sign up or upgrade. Each plan includes certain limits, which may include a number of generation credits per billing period, Digital Mind training capacity, storage, file size limits, and rate limits.

4.2 Free trials. We may offer free trials at our discretion. We may change, end or limit a trial at any time. Unless we tell you otherwise, when a trial ends your access ends unless you subscribe to a paid plan. If a trial requires payment details and converts automatically to a paid plan, we will tell you clearly before you start the trial, including the date you will be charged and how to cancel.

4.3 Credits. Generating content (such as ideas, titles, thumbnails and scripts) uses credits. A credit is used when you start a generation, whether or not you are happy with the result. If a generation fails because of a fault on our side, we may automatically return the credit, subject to reasonable limits that prevent abuse.

4.4 Credit expiry. Unless we state otherwise in writing for a specific promotion or referral offer, credits included in a plan expire at the end of the billing period in which they are issued and do not roll over. Any special credits (such as referral or promotional credits) are subject to the terms stated with that offer.

4.5 Credits have no cash value, cannot be sold or transferred, and are not refundable or exchangeable for money, except where required by law.

4.6 Fair use. You must not try to get around plan limits, for example by creating multiple accounts, automating requests, or interfering with how we measure usage. We may apply rate limits and other technical limits to protect the Service.

5. Fees, billing and automatic renewal

5.1 Fees for paid plans are shown at checkout. Prices may be shown with or without taxes depending on your location; the checkout will make clear which applies.

5.2 Payments are processed by a third-party payment processor such as Stripe or Paddle. We do not receive or store your full card details. If a processor acts as the merchant of record or reseller for your purchase (for example, Paddle), your purchase is also subject to that processor's terms, and the processor's name may appear on your statement.

5.3 Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (for example, monthly or yearly) for the same period, and you authorise us (or our payment processor) to charge your payment method for each renewal at the then-current price, until you cancel. The billing period, price and renewal date are shown at checkout and in your account or billing portal.

5.4 Price changes. We may change our prices. We will give you at least 30 days' notice of a price increase for your subscription. The new price applies from your next billing period after the notice period. If you do not agree, you can cancel before it takes effect.

5.5 Failed payments. If a payment fails, we may retry the charge, and we may suspend or downgrade your access until payment is made.

5.6 Taxes. You are responsible for any taxes that apply to your purchase (such as GST, VAT or sales tax), except taxes on our income, unless they are already included in the price or collected by a merchant of record.

6. Cancellation and refunds

6.1 Cancelling. You can cancel your subscription at any time through your account or billing portal (when available) or by emailing support@makevio.com. Cancellation stops future renewals. You keep access until the end of the billing period you have already paid for.

6.2 No refunds. Except as set out in these Terms or required by law, fees are non-refundable. We do not give refunds or credits for partial billing periods, unused credits, downgrades, or periods where you did not use the Service.

6.3 Your statutory rights. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under law that cannot be excluded, including the consumer guarantees under the Australian Consumer Law. If you are a consumer in the European Union or United Kingdom, you may have a legal right to withdraw from the contract within 14 days. By starting to use the Service immediately, you request that we begin providing it during the withdrawal period, and if you withdraw, you must pay for the Service provided up to that point to the extent permitted by law.

6.4 If we discontinue the Service entirely, we will refund any prepaid fees for the unused part of your billing period.

6.5 Chargebacks. If you believe you were charged in error, please contact us first so we can fix it. If you dispute a valid charge with your bank, we may suspend your account while the dispute is resolved.

7. Your Content

7.1 "Your Content" means anything you upload, submit or provide to the Service, including videos, audio, documents, transcripts, photos, thumbnail inspiration images, niche information, custom instructions and edits.

7.2 You keep ownership. As between you and us, you own Your Content. We do not claim ownership of it.

7.3 Licence you give us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, transcribe, analyse, modify and display Your Content, and to share it with our service providers (including AI model providers), for the purposes of:

You can ask us not to use Your Content for purpose (b) by emailing support@makevio.com. We will honour this for future use. This licence ends when Your Content is deleted from our systems, except that we may keep and use data that has been de-identified or aggregated so that it no longer identifies you, and copies we must keep by law.

7.4 We do not sell Your Content, and we do not allow our AI model providers to use it to train their own models where their terms give us that choice.

7.5 Only upload content you own. You may only upload content that you own, or that its owner has given you permission to upload and use with the Service. You must not upload documents, videos, audio, images or other material owned by someone else (for example, other people's courses, books, videos or paid content) without that permission. The only exception is thumbnail inspiration images, which you may upload solely as a style reference; you must not use the Service to copy or reproduce them. You confirm that Your Content, and our use of it as described in these Terms, does not infringe anyone's rights (including copyright, trade mark, privacy and publicity rights) or break any law. If Your Content includes personal information about other people (such as clients appearing in your videos), you are responsible for having a lawful basis to share it with us.

7.6 You are responsible for keeping your own copies of Your Content and Outputs. The Service is not a backup service.

8. AI-generated Outputs

8.1 "Outputs" means content the Service generates for you, such as video ideas, titles, thumbnail plans, thumbnail images and scripts.

8.2 You own your Outputs. As between you and us, and to the extent permitted by law, you own the Outputs generated for you, and we assign to you any rights we have in them. This does not give you any rights in the Service itself, our prompts or methods, or third-party content or models.

8.3 Limits of AI. Outputs are produced by artificial intelligence and may be inaccurate, incomplete, misleading, offensive, or similar or identical to content generated for other users or that exists elsewhere. Outputs may not be protected by copyright in every country. We do not promise that any Output is unique, original, accurate or fit for any purpose, or that it does not infringe third-party rights.

8.4 Review before you publish. You are solely responsible for reviewing, editing and deciding whether to use any Output, and for everything you publish. In particular, you must make sure that any claim in your titles, thumbnails, scripts and videos (including claims about results, earnings, health, testimonials or your experience) is true, supported, and complies with advertising and consumer protection laws that apply to you, and with YouTube's and other platforms' policies.

8.5 Outputs are not legal, financial, medical, health or other professional advice.

8.6 No guaranteed results. We do not guarantee any results from using the Service or Outputs, including views, subscribers, clicks, leads, booked calls, clients or revenue.

9. Photos and likeness

9.1 The Service lets you upload photos so it can create thumbnails that show you. You may only upload photos of yourself, or of other people who have given you their clear permission to upload their image and have it used to generate AI images.

9.2 You consent to us and our AI providers using the photos you upload to generate images of you, including images showing you in scenes, outfits, poses or situations that are created by AI and did not happen.

9.3 You must not use the Service to create images of any real person without their consent, to impersonate anyone, or to create deceptive, sexual, defamatory or harmful images of anyone.

9.4 We do not use your photos for facial recognition or to identify you.

10. Acceptable use

You must not, and must not allow anyone else to:

11. Feedback

If you give us suggestions or feedback, we may use them freely without paying you or owing you anything.

12. Customer references

We may identify you as a Makevio customer by using your name, business name and logo on our website and in marketing materials. You can ask us to stop at any time by emailing support@makevio.com, and we will stop using them in new materials within a reasonable time. We will not publish your testimonials, results or Your Content without your permission.

13. Third-party services

The Service relies on third-party services, such as hosting, payment processing and AI model providers. We are not responsible for third-party websites or services you choose to use, and your use of them is subject to their terms.

14. Availability and changes to the Service

14.1 We aim to keep the Service available and working, but we do not promise it will be uninterrupted, error-free or always available. We may need to carry out maintenance, and outages may happen.

14.2 We may change, add or remove features of the Service from time to time. If we make a change that significantly reduces the core functionality of your paid plan, we will tell you in advance where reasonably possible, and you may cancel.

14.3 Features labelled as "beta", "preview", "coming soon" or similar are provided as-is, may change or be removed, and may not work as expected.

15. Suspension and termination

15.1 You can stop using the Service and close your account at any time by emailing support@makevio.com.

15.2 We may suspend or terminate your access, with notice where reasonably possible, if:

15.3 We may also terminate these Terms for any reason by giving you at least 30 days' notice, in which case we will refund any prepaid fees for the unused part of your billing period.

15.4 When your access ends, your licence to use the Service ends. We will delete your account and Your Content as described in our Privacy Policy. Clauses that by their nature should continue (including clauses 6, 7.5, 8, 11, 16, 17, 18 and 21) continue after termination.

16. Disclaimers

16.1 To the maximum extent permitted by law, and subject to clause 6.3, the Service and Outputs are provided "as is" and "as available", and we exclude all warranties, conditions and guarantees, whether express or implied, including fitness for a particular purpose, merchantability, accuracy and non-infringement.

16.2 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

17. Limitation of liability

17.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, business, opportunity, goodwill or data, however caused, even if we were told it was possible.

17.2 To the maximum extent permitted by law, our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, and (b) A$100.

17.3 Where the Australian Consumer Law applies and our liability for failing to comply with a consumer guarantee can be limited, our liability is limited (at our option) to supplying the services again or paying the cost of having them supplied again.

17.4 Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

18. Indemnity

To the extent permitted by law, you agree to indemnify us against any claims, losses, damages, costs and expenses (including reasonable legal costs) that arise from (a) Your Content, (b) your use of Outputs, including anything you publish, (c) your breach of these Terms, or (d) your breach of any law or anyone else's rights. This does not apply to the extent the loss was caused by our own breach or negligence.

19. Privacy

Our Privacy Policy explains how we collect, use and protect personal information. It forms part of these Terms.

20. Copyright complaints

If you believe content on the Service infringes your copyright, email support@makevio.com with: your contact details, a description of the work, where the content appears, a statement that you believe in good faith the use is not authorised, and a statement that your notice is accurate and that you are the owner or authorised to act for the owner. We may remove content we reasonably believe infringes someone's rights, and suspend or terminate the accounts of users who repeatedly infringe.

21. Governing law and disputes

21.1 These Terms are governed by the laws of New South Wales, Australia.

21.2 If you have a dispute with us, please contact us first at support@makevio.com. We will both try in good faith to resolve it within 30 days before starting legal proceedings (except for urgent interim relief).

21.3 Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

21.4 If you are a consumer, this clause does not remove any mandatory protection or right you have under the laws of the country where you live, including the right to bring proceedings in your local courts.

22. Changes to these Terms

22.1 We may update these Terms from time to time. If we make material changes, we will notify you by email or in the Service at least 30 days before they take effect, unless the change is required by law or relates to a new feature, in which case it may take effect sooner.

22.2 If you do not agree to the changes, you can cancel before they take effect. If you keep using the Service after they take effect, you agree to the updated Terms.

23. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms, including to a company we control or establish, or as part of a sale or restructure of our business, as long as your rights under these Terms are not reduced. We will tell you if this happens.

24. General

24.1 Entire agreement. These Terms, the Privacy Policy and any terms shown at checkout or with a specific offer are the entire agreement between you and us about the Service.

24.2 Severability. If any part of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent needed, and the rest remains in effect.

24.3 No waiver. If we do not enforce a right, that is not a waiver of it.

24.4 Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, internet failures, natural disasters, or government action.

24.5 Notices. We may send you notices by email to the address on your account or through the Service. You can send notices to support@makevio.com.

24.6 Relationship. Nothing in these Terms creates a partnership, employment, agency or joint venture relationship.
